![]() A Chancellor must present a Budget accompanied by independent economic forecasts prepared by the Office for Budget Responsibility. In place of a Budget, Chancellor Kwasi Kwarteng delivered a fiscal statement on 23 September, which means OBR assessments of the economy will have to wait until later in the financial year. Despite not being a full-scale Budget, there was still a lot of significant changes announced that needed to be understood and implemented. National Insurance rates reduced from 6 November 2022 In March this year the previous Chancellor, Rishi Sunak, announced that National Insurance rates would increase by 1.25% from 6 July, a temporary measure ahead of the introduction of a Health and Social Care Levy in April 2023. Payroll departments and software developers had three months in which to prepare for the increased rates. National Insurance rates were reduced by 1.25% for the remainder of the tax year, though the reduction cannot be backdated. The current Chancellor reversed the increase for the remainder of the tax year on 23 September. Six weeks from now, this reduction will take effect on 6 November. Some employers may not be able to make these changes in time, so refunds may be required. HMRC had previously asked software developers and employers to include a temporary generic message on payslips for the tax year 2022-2023 to explain the reason for the increased NICs. This message will not be applicable from 6 November 2022 and employers should now remove it from payslips. The Health and Social Care Levy, which was scheduled to come in April 2023, has been scrapped. The Class 1 NIC rates for 2022-23 are now as follows: Changes to income tax rates from 6 April 2023 The National Insurance changes had been widely predicted for some time, but changes to income tax came as more of a surprise. Kwasi Kwarteng brought forward by 12 months a planned reduction in the basic rate of income tax from 20% to 19% from 6 April 2023. In addition, he also announced that from the same date the additional rate of income tax of 45% for those earning above £150,000 will be abolished. This means that all annual income above £50,270 will be taxed at 40%, the current higher rate of income tax. These tax cuts apply in England, Wales and Northern Ireland. Scotland sets its own rates so is not affected. Off-payroll working rules repealed The Chancellor didn’t only restrict himself to announcing monetary changes, he also announced changes which the government believes will remove, or at least ease, administrative burdens on businesses, therefore boosting economic growth. And one of these announcements will have a significant impact on many payroll and HR departments, as we now know that the changes to the off-payroll working rules, introduced in the public sector in 2017 and extended to medium and large-sized organisations in the private and voluntary sectors in 2021, will be reversed. This means in practice that from 6 April 2023, workers providing their services via an intermediary will, once again, be responsible for determining their own employment status and paying the correct amount of income tax and National Insurance contributions. Possible employment law changes on the horizon It was only one sentence in the Chancellor’s statement, and his mention of “sunsetting” EU regulations by December 2023 may have been overlooked by those focussing solely on the tax cuts. It doesn’t have the catchiest of titles but the Retained EU Law (Revocation and Reform) Bill which was published on 22 September has the potential to impact everybody in the UK. When we left the EU, legislation was passed which incorporated EU law into UK law. This Bill aims to overturn that, allowing the UK government to make its own legislation. And let’s be honest, that was one of the main drivers for people voting for Brexit. But there is concern in some quarters that the reduction of burdens on business to improve growth may lead to the removal or relaxation of some employment rights such as:

Employers and agencies were permitted to continue hiring despite lockdowns and other covid restrictions due to legislative changes made by the government in response to the pandemic. The emergency measures are now being phased out. At the end of September, one of them, performing Right to Work checks remotely, will end. How can employers and agencies prepare for this?
The ID check, as well as its administrative twin, the Right to Work check, have long been an integral part of onboarding new employees and candidates. In order to prevent illegal working, it is first necessary to verify whether someone is who they claim to be, and secondly, whether they are able to work in the UK. An individual's Right to Work is determined by checking their identification documents (usually their passport and/or immigration documents), and verifying that they are who they claim to be. A person's right to work in the UK is also checked with these documents. Those who fail to conduct proper Right to Work checks on illegally working employees can be fined up to £20,000 per illegal worker. Employers who do their due diligence by performing the correct checks are protected from civil liability by establishing a statutory excuse. It is for this reason that employers and agencies want things to go smoothly. As of 1st October 2022, employers will no longer be able to conduct Right to Work checks over video or with scanned documentation. Right to Work checks should be carried out in one of three ways:
A candidate's immigration status and what documentation is available will greatly influence the method an employer chooses. It is necessary to use the Home Office online checking service in combination with a face-to-face check for individuals who have biometric documents (such as Biometric Residence Cards and Frontier Worker Permits), digital status or E-Visas, or who received their visas through the UK immigration ID check app. British and Irish passport holders, or those with a physical visa (passport vignette), are not eligible for online checks. The check must be performed via an ISDP and a manual verification of original documents. If you have any questions at all regarding digital Right To Work checks, or anything else, don’t hesitate to get in touch. The case centred on the correct application and payment of holiday pay. Harpur Trust had decided to allocate holiday pay at 12.07%, in the case of a worker who was part-time, on a zero-hours contract, and only worked during a limited number of weeks over a year. 12.07% is a figure used by many umbrella companies as a basis on which to retain provision for holiday pay, for those who work a full year (5.6 weeks holiday / 46.4 weeks worked = 12.07%), although on close examination this percentage was incorrect for a worker working a fewer number of weeks over a year.
As a private school, Harpur Trust operated on a 32-week working year and therefore the percentage allocated for holiday pay should have been applied at 17.5% (5.6 weeks/32 weeks worked = 17.5%). Had that provision been made in this case then the correct amount of holiday pay would have been allocated and paid and the case would never have materialised. Key points to note: Where there are periods when a worker will neither be working, nor on paid leave, but where the engagement nevertheless continues, but where those periods are predictable in length, (as is the case in the Education Sector), then as long as the correct percentages are used there is little impact as a result of the ruling. Where there are periods when a worker will neither be working, nor on paid leave, but where the engagement nevertheless continues, and where such periods are not predictable in length, there is more of a problem – because the actual amount which will be needed to make proper provision for holiday pay will depend on the number of unworked weeks, and so cannot be calculated in advance of those weeks. Overarching Employment Contracts and SDC Where non-worked weeks are less predictable, as is the nature of flexible contracts, umbrella companies that continue to operate on the traditional overarching employment contract could face increased risks. Those umbrella companies which rely on overarching employment contracts to support workers operating outside Supervision Direction and Control, which allows those workers to claim expenses, will face the highest risk because the required contractual terms, and operational processes must show an ongoing employment relationship between assignments. One of the main reasons behind using overarching employment contracts is that many agencies require an umbrella contract to guarantee at least 336 hours of work, one of the key mutuality of obligations in such a contract. This is a legacy from the past where, for many years, recruiters have misunderstood that any umbrella that did not include this obligation in their employment contract was likely to be non-compliant. The raft of legislation changes has changed all of this. The SDC legislation confirms that where a worker is under SDC then each assignment will be treated as a separate engagement for employment purposes. This overrides overarching employment terms. And, whilst many umbrella providers use overarching contracts, they are not generally relying on the overarching relationship but merely satisfying the agency demands of guaranteeing 336 hours. Where this is the case, we expect contractual updates to be implemented to tighten termination clauses in contracts to protect companies from the risk of claims as a result of the Harpur Trust vs Brazel ruling. So what will be the outcome for umbrellas? Those engaging workers on overarching employment contracts and other contracts which continue between assignments will probably face the greatest exposure. Without significant changes, they are likely to be at risk of facing challenges and potential significant liabilities. And, umbrellas whose workers have contracts which are not conventionally overarching may not escape lightly and will need to implement updates to their employment contracts, particularly regarding termination clauses. Agencies also need to understand the contractual arrangements operated by their umbrella companies and update themselves on the viable contractual terms that umbrella companies can operate, in the majority of cases without any guarantee of 336 hours. As usual, when there are any changes that affect umbrella companies many are quick to jump in and offer up predictions that the changes could signal the demise of the umbrella industry. Like previous predictions of doom that didn’t come to pass I am sure that this latest case will not mean the end of umbrellas as long as they are quick to act and put the appropriate changes in place to meet the new requirements. |
